Terms of Use

Please read these Terms of Use ("Terms") carefully before using the BrainzUp mobile application (the "App") operated by Ceylon Code Company PVT LTD ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.


1. Acceptance Of Terms

By creating an account or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are under the age of 18, your parent or legal guardian must review and accept these Terms on your behalf; by permitting you to use the App, your parent or guardian agrees to these Terms and accepts responsibility for your use of the App.


2. Description Of Service

BrainzUp is an educational exam preparation and practice application that provides:

  • Access to past exam papers and model papers.

  • Practice questions organized by subject and topic.

  • Custom exam creation with timed allocations.

  • Exam templates for structured practice.

  • Study tracking, streak monitoring, and performance analytics.

  • Study reminders and notifications.

  • The App is available in English, Sinhala, and Tamil.


3. Not An Official Source

Not an official source. BrainzUp is an independent study aid operated by Ceylon Code Company (Pvt) Ltd. It is not an official source of examination information. Where anything in the App conflicts with information published by the Department of Examinations, the Ministry of Education or the National Institute of Education, the official source prevails, and you should rely on it rather than on the App.


4. User Accounts


4.1 Registration

  • You must create an account to access certain features of the App.

  • You agree to provide accurate, current, and complete information during registration.

  • You are responsible for maintaining the confidentiality of your account credentials.


4.2 Account Security

  • You are responsible for all activities that occur under your account.

  • You must notify us immediately at support@brainzup.lk if you become aware of any unauthorized use of your account.

  • We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised.


4.3 Account Termination

  • You may delete your account at any time through the App or by contacting us.

  • We reserve the right to suspend or terminate your account if you violate these Terms.


5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws.

  • Reproduce, distribute, publicly display, or create derivative works from any content available through the App without our prior written permission.

  • Attempt to reverse engineer, decompile, or disassemble the App or any part thereof.

  • Interfere with or disrupt the App's servers, networks, or infrastructure.

  • Use automated systems, bots, or scrapers to access the App.

  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

  • Upload or transmit viruses, malware, or any other harmful code.

  • Share your account credentials with others or allow multiple people to use a single account.

  • Circumvent, disable, or interfere with any security features of the App.

  • Submit content that is unlawful, obscene, defamatory, harassing, or otherwise objectionable, including in question reports or profile information.

  • Deliberately submit random, automated, or bad-faith exam answers, or otherwise attempt to manipulate exam results, streaks, or question statistics.

  • Systematically copy, extract, or redistribute exam questions, papers, or other educational content from the App, or republish such content commercially or publicly.


6. Intellectual Property


6.1 Our Content

  • The App and its content — including our original practice questions, model papers, templates, compilations, categorization, translations, formatting, text, graphics, logos, icons, animations, and software — are the property of Ceylon Code Company PVT LTD or its licensors, and are protected by copyright, trademark, and other intellectual property laws. Certain examination papers and questions in the App are derived from publicly available examination materials published by Sri Lankan authorities, including the Department of Examinations (https://doenets.lk) and the National Institute of Education (https://nie.ac.lk). Those materials remain the property of their issuing authorities. BrainzUp claims no ownership of them and does not publish them as an official or authorised reproduction. Official versions of these papers, together with official syllabi, examination timetables and results, should be obtained from the sources above.

  • You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial educational purposes only.


6.2 User Content

  • You retain ownership of any content you create within the App (e.g., custom exams, templates).

  • By creating content within the App, you grant us a non-exclusive, royalty-free license to use, store, and process such content for the purpose of providing and improving the App.


7. Educational Content Disclaimer

  • The exam questions, papers, and educational materials provided in the App are for practice and preparation purposes only.

  • We do not guarantee that the content reflects the exact format, difficulty, or scope of actual examinations.

  • We are not affiliated with, endorsed by, or authorised by any government entity, examination board or educational authority. This includes the Ministry of Education, the Department of Examinations, the National Institute of Education, and any Provincial Department of Education of Sri Lanka. BrainzUp does not provide or facilitate any government service, and does not conduct examinations, issue results, or set syllabi.

  • The App is a supplementary study tool and should not be relied upon as the sole means of exam preparation.


8. Exam Results And Statistics

  • Exam scores, streaks, and question statistics are meaningful only when exams are attempted genuinely.

  • We may review exam submissions for reliability, and we reserve the right to flag or exclude results that we reasonably believe were not genuinely attempted from statistics, insights, and other performance features.

  • Your answers and results may contribute to aggregated, anonymized statistics (such as question difficulty and performance benchmarks) shown to other users.


9. Advertisements

  • The App displays third-party advertisements through Google AdMob.

  • We are not responsible for the content, accuracy, or availability of third-party advertisements.

  • Your interactions with advertisers are solely between you and the advertiser.


10. Notifications And Reminders

  • The App may send push notifications including study reminders, streak updates, and inactivity alerts.

  • You consent to receiving such notifications when you enable them.

  • You can manage or disable notifications through your device settings or within the App at any time.


11. Availability And Modifications

  • We strive to keep the App available at all times but do not guarantee uninterrupted access.

  • We may modify, suspend, or discontinue the App or any feature at any time without prior notice.

  • We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms.


12. Limitation Of Liability

To the maximum extent permitted by applicable law:

  • The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

  • We do not warrant that the App will be error-free, secure, or uninterrupted.

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

  • Our total liability for any claim arising from or related to the App shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or LKR 5,000, whichever is greater.


13. Indemnification

You agree to indemnify, defend, and hold harmless Ceylon Code Company PVT LTD, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App or violation of these Terms.


14. App Store Terms

  • The App may be downloaded through the Apple App Store or Google Play Store. These Terms are an agreement between you and Ceylon Code Company PVT LTD only, and not with Apple Inc. or Google LLC.

  • Apple and Google are not responsible for the App or its content and have no obligation to provide any maintenance or support services for the App.

  • You agree to comply with the applicable app store's terms of service when using the App.

  • Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.


15. Governing Law And Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of Sri Lanka.

  • Any disputes arising from or relating to these Terms or the App shall be resolved through good-faith negotiation.

  • If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Sri Lanka.


16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.


17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ceylon Code Company PVT LTD regarding your use of the App and supersede any prior agreements.
