Please read these Terms of Use ("Terms") carefully before using the BrainzUp mobile application (the "App") operated by Ceylon Code Company PVT LTD ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. ACCEPTANCE OF TERMS

By creating an account or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are under the age of 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. DESCRIPTION OF SERVICE

BrainzUp is an educational exam preparation and practice application that provides:

- Access to past exam papers, provincial papers, and school papers.

- Practice questions organized by subject and topic.

- Custom exam creation with timed allocations.

- Exam templates for structured practice.

- Study tracking, streak monitoring, and performance analytics.

- Study reminders and notifications.

The App is available in English, Sinhala, and Tamil.

3. USER ACCOUNTS

3.1 Registration

- You must create an account to access certain features of the App.

- You agree to provide accurate, current, and complete information during registration.

- You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

- You are responsible for all activities that occur under your account.

- You must notify us immediately at support@brainzup.lk if you become aware of any unauthorized use of your account.

- We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised.

3.3 Account Termination

- You may delete your account at any time through the App or by contacting us.

- We reserve the right to suspend or terminate your account if you violate these Terms.

4. ACCEPTABLE USE

You agree not to:

- Use the App for any unlawful purpose or in violation of any applicable laws.

- Reproduce, distribute, publicly display, or create derivative works from any content available through the App without our prior written permission.

- Attempt to reverse engineer, decompile, or disassemble the App or any part thereof.

- Interfere with or disrupt the App's servers, networks, or infrastructure.

- Use automated systems, bots, or scrapers to access the App.

- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

- Upload or transmit viruses, malware, or any other harmful code.

- Share your account credentials with others or allow multiple people to use a single account.

- Circumvent, disable, or interfere with any security features of the App.

- Copy, screenshot, or redistribute exam questions, papers, or other educational content from the App.

5. INTELLECTUAL PROPERTY

5.1 Our Content

- All content in the App, including but not limited to exam questions, papers, templates, text, graphics, logos, icons, animations, and software, is the property of Ceylon Code Company PVT LTD or its licensors.

- The content is protected by copyright, trademark, and other intellectual property laws.

- You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial educational purposes only.

5.2 User Content

- You retain ownership of any content you create within the App (e.g., custom exams, templates).

- By creating content within the App, you grant us a non-exclusive, royalty-free license to use, store, and process such content for the purpose of providing and improving the App.

6. EDUCATIONAL CONTENT DISCLAIMER

- The exam questions, papers, and educational materials provided in the App are for practice and preparation purposes only.

- We do not guarantee that the content reflects the exact format, difficulty, or scope of actual examinations.

- We are not affiliated with any examination board or educational authority unless explicitly stated.

- The App is a supplementary study tool and should not be relied upon as the sole means of exam preparation.

7. ADVERTISEMENTS

- The App displays third-party advertisements through Google AdMob.

- We are not responsible for the content, accuracy, or availability of third-party advertisements.

- Your interactions with advertisers are solely between you and the advertiser.

8. NOTIFICATIONS AND REMINDERS

- The App may send push notifications including study reminders, streak updates, and inactivity alerts.

- You consent to receiving such notifications when you enable them.

- You can manage or disable notifications through your device settings or within the App at any time.

9. AVAILABILITY AND MODIFICATIONS

- We strive to keep the App available at all times but do not guarantee uninterrupted access.

- We may modify, suspend, or discontinue the App or any feature at any time without prior notice.

- We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

- The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

- We do not warrant that the App will be error-free, secure, or uninterrupted.

- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

- Our total liability for any claim arising from or related to the App shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or LKR 5,000, whichever is less.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Ceylon Code Company PVT LTD, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App or violation of these Terms.

12. GOVERNING LAW AND DISPUTE RESOLUTION

- These Terms shall be governed by and construed in accordance with the laws of Sri Lanka.

- Any disputes arising from or relating to these Terms or the App shall be resolved through good-faith negotiation.

- If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Sri Lanka.

13. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ceylon Code Company PVT LTD regarding your use of the App and supersede any prior agreements.
